RAWALPINDI: Chief of Army Staff (COAS) General Qamar Javed Bajwa on Monday confirmed the death sentence awarded to Indian RAW Agent Kulbushan Sudhir Jadhav by Field General Court Martial (FGCM).
According to Inter-Services Public Relations (ISPR), the spy was tried by FGCM under section 59 of Pakistan Army Act (PAA) 1952 and Section 3 of official Secret Act of 1923. FGCM found Kulbushan Sudhir Yadhav guilty of all the charges.
Indian RAW Agent /  Naval officer 41558Z Commander Kulbushan Sudhir Jadhav alias Hussein Mubarak Patel  was arrested on  March 3, 2016 through a Counter Intelligence Operation from Mashkel, Balochistan, for his involvement in espionage and sabotage activities against Pakistan.
He confessed before a Magistrate and the Court that he was tasked by RAW to plan, coordinate and organize espionage / sabotage activities aiming to destabilize and wage war against Pakistan by impeding the efforts of Law Enforcement Agencies for restoring peace in Balochistan and Karachi.
The accused was provided with defending officer as per legal provisions.
Defence Minister Khawaja Asif on Monday stressed that the death sentence of convicted RAW agent Kulbhushan Jadhav was according to the law, adding that the Indian government backed him to cause unrest in Balochistan.
He said, "India is not our well-wisher," and the neighbouring country sponsored cross-border terrorism in Pakistan.
Khawaja Asif told that India's Research and Analysis Wing (RAW) had joined hands with National Directorate of Security in Afghanistan to spread restlessness in Balochistan and sabotage the China-Pakistan Economic Corridor (CPEC).
"No leniency will be given to those with anti-Pakistan sentiments," he added while saying that the death sentence of Kulbhushan Jadhav was according to the laws.
The Defence Minister believes that death sentence to Kulbhushan Jadhav under Field General Court Martial (FGCM) by Pakistan Army for espionage and sabotage activities was a warning to enemies of the country. "The decision will help eradicate terrorism in Balochistan," he said.
On the other hand, Balochistan Interior Minister Sarfaraz Bugti, while talking to media, considered the matter a symbol of victory for Pakistan as Kulbhushan Jadhav represented a terrorist organization. He also believes that the death sentence to convicted RAW agent will help fight terrorism in the country
In a stinging response to Pakistan sentencing RAW Agent Kulbushan Sudhir Jadhav to death, Indian Foreign Secretary Jaishankar on Monday summoned the Pakistan High Commissioner Abdul Basit and issued a demarche, terming the proceeding that led to his sentencing as 'farcical.'
"If basic norms of law and justice are not observed, the Government of India will regard it as premeditated murder if the sentence is carried out," the demarche stated.
Basit was also told that the Indian High Commission was not even informed that Jadhav was being brought to trial, the Indian media reported.
India was denied consular access to Jadhav 13 times by the Pakistan authorities, it said. Jadhav's presence in Pakistan was never explained and, it added, that he was kidnapped from Iran.
Responding to a question regarding death sentence awarded to Indian naval officer Kulbhushan Yadav on charges of spying and terrorism, PPP Chairman Bilawal Bhutto reiterated his party's stance against the capital punishment.
"Pakistan People's Party (PPP) opposes death sentence. We don't believe in death penalty in general," Bhutto told media persons.
"I have a principled stance whoever may be involved. What happened to my grandfather (Zulfikar Ali Bhutto) so I don't have faith in death penalty," he maintained.
When pressed, he said that it was a controversial issue. The Indian spy shouldn't have been here. Although there case is special, but I am talking about the death penalty in principle."
